Terms and Conditions

By booking any service with Wild Chronicles Safaris, clients confirm they have read, understood, and agreed to these Terms and Conditions. These terms constitute a binding agreement between the client and Wild Chronicles Safaris (Registration No. PVT-WQ12YAE). Clients are advised to read this document carefully before making any booking or payment.

1. DEFINITIONS

In these Terms and Conditions, the following terms shall have the meanings ascribed to them below:
1.1 “Company” means Wild Chronicles Safaris, a private company registered in Kenya with its principal place of business at Maiyan Mall, 1st Floor, Suite SF-27, Nairobi, Kenya.
1.2 “Client” means any individual, group, or corporate entity that books or inquires about a service offered by the Company, including all members of a travelling party.
1.3 “Safari” or “Tour” means any travel itinerary, package, excursion, or service arranged, organized, or facilitated by the Company on behalf of the Client.
1.4 “Booking” means a confirmed reservation made by the Client for a Safari or Tour, acknowledged in writing by the Company upon receipt of the applicable deposit.
1.5 “Force Majeure” means any event or circumstance beyond the Company’s reasonable control, including but not limited to natural disasters, acts of God, government action, civil unrest, epidemics, pandemics, terrorism, strikes, or infrastructure failures.
1.6 “Departure Date” means the first day of the confirmed Safari itinerary as specified in the booking documentation.

2. BOOKINGS & RESERVATIONS

2.1 All bookings are subject to availability and shall only be deemed confirmed upon receipt by the Company of the required deposit and the issuance of a written booking confirmation by the Company.
2.2 A non-refundable deposit of 30% of the total tour cost is required to secure a booking. This deposit is non-refundable under any circumstances, except as expressly provided under Clause 6 of these Terms.
2.3 The remaining balance of the total tour cost is due no later than 30 days before the Departure Date. Failure to settle the outstanding balance by the due date may result in cancellation of the booking, subject to the cancellation charges outlined in Clause 5.
2.4 For bookings made within 30 days of the Departure Date, full payment of the total tour cost is required at the time of booking.
2.5 All bookings are confirmed in writing either by email or via a signed booking agreement issued by an authorized representative of the Company. Verbal or informal confirmations do not constitute a binding booking.
2.6 The Company reserves the right to decline or cancel any booking at its discretion, in which case all monies paid by the Client shall be refunded in full.

3. PRICING & PAYMENTS

3.1 All prices are quoted in Kenya Shillings (KES) or US Dollars (USD), as specified in the relevant itinerary or quotation issued to the Client.
3.2 Prices quoted prior to booking confirmation are indicative only and are subject to change. Prices are locked at the time a booking is confirmed upon receipt of the required deposit.
3.3 Accepted payment methods include:
(a) Bank transfer to the Company’s designated account;
(b) Such other payment methods as the Company may specify in writing from time to time.
3.4 All bank transfer charges, currency conversion fees, and transaction fees are the sole responsibility of the Client. Payments must be received in full by the Company, net of any such charges.
3.5 The Company reserves the right to adjust quoted prices with reasonable prior written notice to the Client to account for changes in government taxes, national park fees, fuel levies, or other cost factors beyond the Company’s control. Where a confirmed booking is affected by such increases exceeding 10% of the total tour cost, the Client shall have the right to cancel without penalty.

4. CANCELLATION POLICY-CLIENT

4.1 All cancellation requests must be submitted in writing to the Company by email at info@wildchroniclessafaris.com. Cancellations shall take effect on the date the written notice is received by the Company.
4.2 Cancellation charges are calculated as a percentage of the total tour cost based on the period of notice given before the Departure Date, as set out in the schedule below:

14 days or fewer before Departure 100% of total tour cost — no refund
4.3 No refunds shall be made for any unused portions of a Safari once the tour has commenced, including but not limited to unused accommodation, meals, transfers, or activities.
4.4 The Company strongly recommends that Clients obtain comprehensive travel insurance inclusive of trip cancellation coverage to protect against unforeseen circumstances that may necessitate cancellation.

5. CANCELLATION OR MODIFICATION BY THE COMPANY

5.1 The Company reserves the right to cancel or materially modify a confirmed Safari due to Force Majeure events, insufficient bookings to operate the tour viably, safety concerns, or any other circumstances beyond its reasonable control.
5.2 In the event of a Company-initiated cancellation, the Company shall notify the Client as promptly as reasonably practicable and shall offer the Client, at the Client’s election, either:
(a) A full refund of all monies paid by the Client to the Company in respect of the cancelled Safari; or
(b) An alternative Safari of equivalent or greater value, subject to availability and mutual agreement.
5.3 The Company shall not be liable for any additional costs or losses incurred by the Client as a consequence of such cancellation or modification, including but not limited to independently booked flights, visa fees, travel insurance premiums, or pre- or post-tour accommodation.
5.4 Minor itinerary modifications (such as changes to lodges of equivalent standard, route adjustments, or activity substitutions) shall not constitute a cancellation and shall not entitle the Client to a refund.

6. CHANGES & AMENDMENTS

6.1 Requests by the Client to amend a confirmed booking — including changes to travel dates, destinations, participants, or accommodation — must be submitted in writing to the Company and are subject to availability. The Company will use reasonable endeavors to accommodate such requests.
6.2 Client-requested amendments may attract an administration fee and may be subject to additional costs arising from changes in supplier pricing. Any such charges will be communicated to the Client prior to the amendment being confirmed.
6.3 Itinerary modifications made during the course of a Safari — including changes to routes, game park locations, scheduled activities, or accommodation — may be necessary due to weather conditions, wildlife movement, road conditions, government directives, or safety considerations. Such modifications are made at the discretion of the lead guide or Company representative and do not entitle the Client to any refund or compensation.

7. TRAVEL DOCUMENTS & REQUIREMENTS

7.1 Clients are solely and entirely responsible for ensuring that they and all members of their travelling party hold valid passports, visas, entry permits, travel authorizations, and any required health certificates or vaccination records for all countries to be visited during the Safari.
7.2 The Company will not be held liable for any loss, cost, damage, delay, or disruption arising directly or indirectly from a Client’s failure to obtain or maintain correct, current, or valid travel documentation.
7.3 Clients are strongly advised to consult the relevant embassy or consular services of the destination country well in advance of travel to confirm entry requirements, as these may change without notice.
7.4 The Company strongly recommends that all Clients obtain comprehensive travel insurance — prior to and effective from the date of booking — covering as a minimum:
(a) Medical emergencies and hospitalization;
(b) Emergency medical evacuation and repatriation;
(c) Trip cancellation, interruption, and curtailment;
(d) Loss, theft, or damage of personal belongings and baggage; and
(e) Personal accident and liability coverage.

8. HEALTH, FITNESS & SPECIAL REQUIREMENTS

8.1 Clients must disclose to the Company, at the time of booking, any medical conditions, physical limitations, disabilities, dietary requirements, allergies, or other special needs that may affect participation in the Safari or the Company’s ability to provide appropriate services.
8.2 The Company will make all reasonable efforts to accommodate disclosed special requirements; however, it cannot guarantee the fulfillment of all requests, particularly where third-party service providers are involved.
8.3 Clients participate in all Safari activities — including but not limited to game drives, walking safaris, water activities, and bush experiences — voluntarily and entirely at their own risk. Clients must satisfy themselves, in advance of the Safari, that they are physically fit and medically suitable to undertake the chosen activities.
8.4 The Company reserves the right to exclude any Client from participating in a specific activity where, in the reasonable opinion of the guide or Company representative, such participation poses a risk to the Client or to others.

9. LIABILITY & INDEMNITY

9.1 Wild Chronicles Safaris acts as the organizer and agent of travel services provided by independent third-party operators including, without limitation, lodges, hotels, airlines, charter operators, vehicle hire companies, and national park authorities. The Company is not the owner or direct operator of such services and shall not be liable for any injury, illness, death, loss, damage, delay, additional expense, or inconvenience arising from any act, omission, negligence, default, or breach by such third-party service providers.
9.2 The Company’s total aggregate liability to any Client in respect of any claim or series of claims arising from a single Safari shall not exceed the total amount paid by the Client to the Company in respect of that Safari.
9.3 The Client agrees to indemnify and hold harmless the Company, its directors, employees, guides, and agents from and against any claim, loss, damage, cost, or liability arising from the Client’s breach of these Terms and Conditions or the Client’s own negligence or misconduct.
9.4 Nothing in these Terms and Conditions shall operate to limit or exclude the Company’s liability for death or personal injury caused directly by the Company’s own proven negligence or willful misconduct.

10. BEHAVIOR & CODE OF CONDUCT

10.1 Clients are expected to conduct themselves in a responsible, respectful, and lawful manner at all times throughout the Safari, including toward wildlife, local communities, the natural environment, fellow travelers, Company staff, and third-party service providers.
10.2 Clients must comply with and follow all instructions given by the Company’s guides, park rangers, lodge staff, and any other authorized personnel at all times. Non-compliance may result in exclusion from activities or termination of the Safari.
10.3 The Company reserves the right to terminate a Client’s participation in a Safari, without refund, if the Client’s conduct is deemed by the Company’s representative to be:
(a) Dangerous or reckless to themselves, wildlife, or others;
(b) Disruptive, abusive, or threatening toward staff, guides, or fellow travelers; or
(c) Disrespectful to local cultures, park regulations, or wildlife conservation principles.
10.4 Clients must comply with all applicable Kenyan laws, regulations, and national park rules at all times. Any fines, penalties, or legal consequences arising from a Client’s breach of applicable laws are solely the Client’s responsibility.

11. PHOTOGRAPHY & PRIVACY

11.1 Clients may photograph and record wildlife, landscapes, and safari experiences for their own personal, non-commercial use. Commercial use of such photography requires the prior written consent of the Company and, where applicable, relevant third parties or authorities.
11.2 Photography of or within local communities, cultural sites, or of individual persons must be conducted respectfully and with the express permission of the individuals or community concerned. Clients must follow all guide instructions regarding photography restrictions in sensitive areas.
11.3 The Company may use photographs, videos, or testimonials captured during safaris in its marketing, promotional, and social media materials. Clients who do not consent to such use must notify the Company explicitly in writing at the time of booking.
11.4 The Company collects and processes personal data provided by Clients solely for the purpose of delivering booked services and communicating relevant information. Personal data is handled in accordance with the Kenya Data Protection Act, 2019, and applicable regulations thereunder.

12. COMPLAINTS & DISPUTE RESOLUTION

12.1 The Company is committed to delivering high-quality safari experiences. Any complaint or concern arising during a Safari must be raised with the lead guide or Company representative immediately upon occurrence, so that the Company is given the opportunity to address and resolve the matter promptly.
12.2 Formal written complaints must be submitted to the Company by email at Info@wildchroniclessafaris.com within 14 days of the Safari’s conclusion. Complaints received after this period may not be considered.
12.3 The Company will acknowledge receipt of a written complaint within 5 business days and will use reasonable endeavors to investigate and resolve the matter within 21 business days of acknowledgment.
12.4 In the event that a dispute cannot be resolved amicably between the parties, the matter shall be subject to the laws of the Republic of Kenya and the exclusive jurisdiction of the courts of Nairobi, Kenya, as further provided under Clause 14 of these Terms.

13. FORCE MAJEURE

13.1 The Company shall not be liable for any failure or delay in performing its obligations under a confirmed booking where such failure or delay results from a Force Majeure event, including but not limited to:
(a) Natural disasters, floods, earthquakes, fires, or extreme weather events;
(b) Acts of God or circumstances entirely beyond human control;
(c) Government actions, travel bans, border closures, or regulatory changes;
(d) Civil unrest, war, terrorism, or political instability;
(e) Epidemics, pandemics, or public health emergencies; or
(f) Strikes, industrial action, or infrastructure failures affecting transport or utilities.
13.2 In circumstances of Force Majeure, the Company will act in good faith and use reasonable endeavors to work collaboratively with affected Clients to reschedule bookings, provide credits for future travel, or explore such other remedies as may be fair and practicable under the circumstances.
13.3 The Company shall have no obligation to provide refunds for costs or losses attributable to Force Majeure events, including any costs borne by the Client independently of the Company (such as flights, visas, or additional accommodation).

14. GOVERNING LAW

14.1 These Terms and Conditions are governed by, and shall be construed in accordance with, the laws of the Republic of Kenya.
14.2 Any dispute, claim, or matter arising out of or in connection with these Terms and Conditions — or a booking made with the Company — shall be submitted to the exclusive jurisdiction of the courts of Nairobi, Kenya.
14.3 If any provision of these Terms and Conditions is found by a competent court to be invalid, unlawful, or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.

15. ACCEPTANCE OF TERMS

15.1 Payment of the required deposit, or confirmation of a booking by any other means, constitutes the Client’s full, unconditional, and legally binding acceptance of these Terms and Conditions in their entirety.
15.2 Where a booking is made on behalf of a group, the individual making the booking confirms that they have the authority to act on behalf of all members of the group and that all group members are bound by these Terms and Conditions.
15.3 The Company reserves the right to update or amend these Terms and Conditions from time to time. The version of the Terms and Conditions in effect at the date of booking confirmation shall apply to that booking. Updated versions will be published on the Company’s website at www.wildchroniclessafaris.com.

16. AUTHORIZED SIGNATORY

These Terms and Conditions are issued and authorized on behalf of Wild Chronicles Safaris by the undersigned duly authorized representative:
